Fan Content Policy

Here at Big Blue Bubble we love seeing all the creations that our community puts together to share their love of My Singing Monsters and all of the Big Blue Bubble brands. We also know that our users want to use in-game assets to make some of the cool stuff they send in. Knowing this we have created the following guidelines as a way of addressing any questions fans might have about the use of Big Blue Bubble’s Intellectual Property (IP), refer to Section 2.1 of the Terms of Service.

Our Fan Content Policy outlines your use of any of Big Blue Bubble’s IP including but not limited to copyrights and trademarks regarding any Big Blue Bubble property, this includes in-game assets, marketing material, physical goods, and any related Fan collateral provided by anyone from Big Blue Bubble (“Big Blue Bubble Assets”) for Fan Content Purposes. In this Policy, “Fan Content” includes the following and not limited to: your fan art (i.e. artwork, photographs, music, videos, and other materials) that is based on Big Blue Bubble IP; and your Big Blue Bubble IP-related personal, non-commercial websites and apps that are freely accessible to the public.

Please read this Policy carefully and before creating any Fan Content. We reserve the right to change this Policy at any time by posting a revised Policy to our website. Any existing Fan Content that no longer complies with this Policy due to any changes that may have been made, must be modified to be compliant with the Policy or removed.

1 General rules

1.1 You may create Fan Content based on Big Blue Bubble IP as long as you comply with the rules outlined in this Policy. Any Fan Content that violates this Policy is prohibited and will be requested for removal.

1.2 This Policy applies to Big Blue Bubble’s IP in accordance with Big Blue Bubble’s Terms of Service, end user license agreements, Privacy Policy, and/or other agreements you have with Big Blue Bubble.

1.3 All Fan Content must be appropriate for the audience of Big Blue Bubble IP and exhibit that same spirit and tone of Big Blue Bubble’s IP (as determined by Big Blue Bubble). Fan Content must comply with applicable law, may not violate the rights of others, and must not be obscene, sexually explicit, defamatory, offensive, objectionable, or harmful to others.

1.4 Fan Content must have no commercial (i.e. monetary) objective. As an exception to this, fans are permitted to monetize web videos (such as YouTube) with advertisements, so long as those videos otherwise meet the requirements of this Policy.

1.5 Big Blue Bubble, in its sole discretion, can revoke your permission to create or publish Fan Content at any time and for any reason.

1.6 You may not say nor imply that your Fan Content is endorsed or approved by Big Blue Bubble.

1.7 Your Fan Content may not include links to any websites that promote or exploit cheats or hacks to Big Blue Bubble’s games or any other games.

1.8 You may not create or use any Fan Content in a manner that could cause people to believe that it is an official Big Blue Bubble production. For example, a fan site should not be made to look like an official Big Blue Bubble website, and it must be clear to visitors that the website is not a Big Blue Bubble website.

1.9 You may not use Big Blue Bubble IP in any manner that is derogatory to Big Blue Bubble or that may damage the value, reputation, or goodwill of Big Blue Bubble or its products or brands (as determined by Big Blue Bubble).

1.10 You must display the following disclaimer on or in connection with your Fan Content, including on any web page containing your Fan Content:

“Portions of the materials used are trademarks and/or copyrighted works of Big Blue Bubble. All rights reserved by Big Blue Bubble. This material is not official and is not endorsed by Big Blue Bubble.”

1.11 If you use Big Blue Bubble’s brands, logos, game titles, character names, or other trademarks in connection with your Fan Content, you must follow these rules:

Trademarks must be used only in connection with discussion of Big Blue Bubble products or businesses they represent. Do not use trademarks to identify or promote yourself, your Fan Content, or any other products or businesses.
Trademarks must be used in a manner that will enhance and not damage the reputation and goodwill associated with the trademarks.
Do not use any trademarks in the name of a website unless it is clear from the name that the website is not an official Big Blue Bubble website.
Do not register or use any domain name that is confusingly similar to our domain names.
Do not alter any trademarks. Example:

2 Your agreement with Big Blue Bubble

Except for the limited permission described in Section 1 above, your use of any Big Blue Bubble IP is subject to Big Blue Bubble’s Terms of Service, end user license agreements, Privacy Policy, and other agreements you may have with Big Blue Bubble regarding the websites, games, and other materials from which you access the Big Blue Bubble IP. Those agreements include important legal terms, so please review those agreements carefully before creating any Fan Content.

3 Do not send Big Blue Bubble your Fan Content or game ideas

Please do not send your unsolicited Fan Content or game ideas to Big Blue Bubble; anything sent to Big Blue Bubble will become the sole property of Big Blue Bubble and/or will be deleted without review.

4 Enforcement of Rights

Big Blue Bubble reserves the right to take any remedy to enforce Big Blue Bubble’s IP rights and ownership, including legal action against anyone for misuse, violation, and/or infringement of Big Blue Bubble IP, Terms of Service, end user license agreements, Privacy Policy, and other agreements you may have.
